Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, customer portals, and hosting, security, and IT services (collectively, the “Services”) provided by Pro IT Hosting, LLC (“Pro IT Hosting,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.
1. Accounts
You must provide accurate information and keep your account credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
2. The Services
We provide managed hosting, security, and information-technology services as described in your order or service agreement. We may modify or discontinue features, and we will use commercially reasonable efforts to maintain availability of the Services.
3. Acceptable Use
You agree not to use the Services to store or transmit unlawful, infringing, or harmful content; to send unsolicited bulk messages (spam); to attempt to gain unauthorized access to any system; or to interfere with the operation or security of the Services or any network. We may suspend or terminate accounts that violate these Terms or applicable law.
4. Billing & Payment
Fees are due as stated in your order. Recurring services renew until cancelled. Late or failed payments may result in suspension. Except where required by law, fees are non-refundable.
5. SMS, Text, and RCS Messaging Terms
By providing a mobile number and opting in, you agree to receive SMS and RCS messages from Pro IT Hosting related to your account and our Services, including one-time passcodes (OTPs), security alerts, support and appointment notifications, and billing reminders. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time or HELP for help. Consent to receive messages is not a condition of purchase. We do not sell or share mobile opt-in data with third parties for their marketing. See our Privacy Policy for details.
6. Intellectual Property
The Services, including our software, content, and trademarks, are owned by Pro IT Hosting or our licensors and are protected by law. You retain ownership of the content you upload; you grant us the limited rights needed to host and operate the Services for you.
7. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PRO IT HOSTING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE MONTHS BEFORE THE CLAIM.
9. Indemnification
You agree to indemnify and hold Pro IT Hosting harmless from claims arising out of your use of the Services or your violation of these Terms or applicable law.
10. Termination
Either party may terminate as described in your service agreement. We may suspend or terminate access for violations of these Terms. Upon termination, your right to use the Services ceases.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Florida.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date; continued use of the Services constitutes acceptance.
